Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Now Track mobile application, web platform, dashboards, APIs, and related services (collectively, the “Services”).

Now Track is a fleet telematics and vehicle tracking platform owned and operated by Norq Technology Solutions Pvt. Ltd., a company incorporated under the laws of India (“Norq”, “Company”, “we”, “our”, or “us”).

By downloading, installing, registering for, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services.

1. Eligibility & Account Registration

  1. You must be at least 18 years of age to use the Services.
  2. You represent that you are authorized to act on behalf of the vehicle owner, fleet owner, or organization, where applicable.
  3. You agree to provide accurate, complete, and current information during registration.
  4. You are solely responsible for maintaining the confidentiality of your login credentials.
  5. All activities carried out through your account shall be deemed to be performed by you.

2. Description of Services

Now Track is a fleet telematics and vehicle monitoring platform that provides, among other features

  • Real-time vehicle tracking
  • Historical trip data and analytics
  • Alerts and notifications
  • Compliance and regulatory integrations
  • Reporting dashboards
  • Mobile and web-based access

The Services support both:

  • AIS-140 compliant vehicles
  • Non-AIS-140 vehicles

Features and availability may vary based on:

  • Device capability
  • Network connectivity
  • Regulatory requirements
  • Subscription or service plan

3. Regulatory Compliance (AIS-140 & Similar Mandates)

  1. For vehicles governed by AIS-140 or similar statutory mandates, vehicle and location data may be automatically transmitted to relevant government, transport, or emergency response systems as required by law.
  2. Norq acts solely as a technology service provider and does not guarantee regulatory approvals, certifications, or outcomes.
  3. Compliance with applicable laws, vehicle fitness, and regulatory obligations remains the sole responsibility of the user.

4. User Responsibilities

You agree to:

  • Use the Services strictly for lawful and authorized purposes
  • Ensure proper installation, operation, and maintenance of tracking devices
  • Comply with all applicable transport, IT, and data protection laws
  • Obtain all required consents from drivers, employees, or vehicle users
  • Immediately notify Norq of any unauthorized account access

You shall not:

  • Use the Services for illegal surveillance or tracking
  • Reverse-engineer, copy, modify, or exploit the platform
  • Circumvent security controls or access restrictions
  • Interfere with system integrity or performance

5. Location Tracking & Consent

  1. The Services rely on continuous or periodic location data collection.
  2. By using Now Track, you confirm that you have obtained all necessary permissions and consents from affected individuals.
  3. Location tracking is a core functional requirement and disabling it may limit or prevent Service functionality.

6. Service Availability & Limitations

  1. The Services depend on external factors such as GPS signals, mobile networks, hardware health, and power availability.
  2. Norq does not guarantee uninterrupted, error-free, or real-time availability.
  3. Temporary interruptions may occur due to maintenance, upgrades, or force majeure events.

7. Fees, Billing & Payments

  1. Certain Services may be subject to subscription fees or usage-based charges.
  2. Pricing, billing cycles, and payment terms shall be communicated separately.
  3. Failure to make timely payments may result in suspension or termination of access.

8. Intellectual Property Rights

  1. All intellectual property related to the Services, including software, source code, designs, trademarks, logos, and documentation, is owned by Norq Technology Solutions Pvt. Ltd.
  2. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services.
  3. No rights are granted except as expressly stated in these Terms.

9. Third-Party Services & Integrations

  1. The Services may integrate with third-party hardware, platforms, or government systems.
  2. Norq is not responsible for the performance, availability, or accuracy of third-party services.
  3. Use of third-party services is governed by their respective terms.

10. Data Ownership & Usage

  1. You retain ownership of your vehicle and operational data.
  2. By using the Services, you grant Norq a limited right to process such data solely to:
    • Provide and operate the Services
    • Meet legal and regulatory obligations
    • Improve system performance and reliability
  3. Data handling is governed by the Privacy Policy, which forms an integral part of these Terms.

11. Suspension & Termination

Norq may suspend or terminate access:

  • For violation of these Terms
  • For non-payment of applicable fees
  • For suspected misuse or unlawful activity
  • Where required by law or regulatory authority

You may request termination of your account subject to contractual and regulatory obligations.

12. Disclaimer of Warranties

The Services are provided on an “as-is” and “as-available” basis.

Norq disclaims all warranties, including but not limited to:

  • Accuracy or completeness of data
  • Fitness for a particular purpose
  • Uninterrupted or error-free operation
  • Compliance outcomes

Telematics data may be delayed, inaccurate, or unavailable due to external factors.

13. Limitation of Liability

To the maximum extent permitted by law:

  1. Norq shall not be liable for indirect, incidental, consequential, or punitive damages.
  2. Norq shall not be liable for losses arising from device failure, network outages, regulatory actions, or third-party services.
  3. Norq’s total aggregate liability shall not exceed the fees paid by you for the Services during the preceding twelve (12) months.

14. Indemnification

You agree to indemnify and hold harmless Norq from any claims, damages, liabilities, or expenses arising from:

  • Your use or misuse of the Services
  • Violation of applicable laws or regulations
  • Failure to obtain required consents
  • Infringement of third-party rights

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Courts within India shall have exclusive jurisdiction.

16. Modifications to the Terms

Norq may revise these Terms from time to time.

Updated versions will be posted on the website or within the application. Continued use constitutes acceptance of the revised Terms.

17. App Store Specific Disclosures

Google Play Store

  • The app collects and processes data as disclosed in the Privacy Policy.
  • Location access is required for core telematics functionality.
  • Data is not sold or used for advertising purposes.

Apple App Store

  • Background location access is used for continuous vehicle tracking and alerts.
  • Data collection complies with Apple App Store Review Guidelines.
  • Permissions can be managed through device settings.
